GENERAL TERMS AND CONDITIONS OF BUSINESS
1.0 VALIDITY AND SCOPE
1.1 These General Terms and Conditions for the online shop (“Terms and Conditions Online”) regulate additionally
to the General Terms and Conditions (“Terms and Conditions”) that also apply to the online shop
the contractual relationship between SWISSPLANKTON owner Martin Speck, Aufwiesenstrasse 28 8305 Dietlikon
(Tueetlikon) (hereinafter: Swissplankton) and iyour customers (hereinafter: the customer) for services
the Swissplankton in the online shop.
Different agreements betweenSwissplankton and the customer require this to be in writing.
1.2 The General Terms and Conditions Online and the General Terms and Conditions can be found on the Swissplankton homepage

2.0 OFFER AND CONCLUSION OF CONTRACT
2.1 Products Swissplankton Swissplankton are subject to change and are subject to change

All product information, photos, technical specifications, accessory names and the like in the online shop are provided without guarantee. 3.0 CONTRACT TEXT
3.1 The contract text is stored on Swissplankton’s internal systems. It applies supplemented by the General Terms and Conditions and the General Terms and Conditions Online.
4.0 CANCELLATION POLICYCHT
4.1 Ordered goods can be returned by the customer to Swissplankton at their own expense within 7 days of the date of delivery.
4.2. This excludes all items ordered for you that we do not have in stock as well as all of our products that we offer on special offer.
4.3 The customer must notify Swissplankton of the revocation within the same period by email to the address info@swissplankton.ch. Items affected by the revocation must be returned to Swissplankton's business address on time in the unopened and undamaged original packaging or delivered to Swissplankton's business address during Swissplankton's published opening hours. Only items will be taken back if the item and packaging are in an undamaged and perfect, unused condition.
4.4 Goods that cannot be sent by post can be picked up by Swissplankton at the customer's request at the customer's expense.
4.5 In the event of an effective cancellation, Swissplankton will refund the customer a credit in the form of a voucher for the services already received, less the shipping costs incurred by us (for normal mail up to 32 kg) of CHF 15.-, less a processing fee of CHF 35.- ,after receipt of the returned goods. The customer can use this voucher on his next purchase.
4.6 Bulky goods and truck deliveries will be invoiced to the customer 1 to 1. As already described above, there is also an additional processing fee of CHF 69.
4.7 There is no right to a refund for goods where the packaging or product has been damaged or used.
4.8 Depending on the circumstances and condition of the goods, Swissplankton can consider a limited refund through goods credit as a gesture of goodwill.
5.0 PRICES AND SHIPPING COSTS
5.1 All prices include VAT and any other statutory charges.

5.2 The price is the price advertised in the store (for physical stores) or in the online shop (for online stores).
or published price at the time of conclusion of the contract.
5.3 The prices stated on the product pages include statutory VAT and other price components.
6.0 SHIPPING COSTS
6.1 The shipping costs depend on the quantity of goods ordered and the shipping method

7.0 SUPPLIES OF ANIMALS (Invertebrates and Vertebrates)
7.1 The delivery of fish (vertebrates) and corals (invertebrates) will be processed separately.
7.2 The delivery of fish (vertebrates) is delivered by our Swissplankton fish delivery service.
7.3 a The delivery of corals, snails, crabs, etc. (invertebrates) is sent via Swiss Mond Express.
7.3 b Please note that Swissplankton expressly excludes compensation for damages caused by postal express shipments of animals or live stones that are delivered late. Each customer is responsible for whether they want to accept this risk (delayed express deliveries). Unfortunately, the post office will not provide any compensation for the damage caused. As a gesture of goodwill, Swissplankton will therefore refund you a partial amount of 1/3 of the value of the goods (excluding shipping costs) in the form of a credit note.
7.3 c Is your coral no longer alive upon arrival? Please send us photos of it immediately and on the same day.
This is the only way we (Swissplankton Coral Shipping Guarantee) can refund you any credit of 1/3 of the purchase price (excluding shipping costs) in the form of a credit.
7.4 Delivery of aquarium material
7.3 Delivery only takes place within Switzerland.
7.4 The delivery time is usually 3-4 working days. We will point out any different delivery times on the respective product page.
7.5 If the ordered product cannot be delivered on time because our supplier does not supply us with this product on time, we will inform you immediately. In such a case, you are free to wait for the product you ordered or to cancel your order. In the event of a cancellation, any consideration already provided will be refunded immediately.
8.0 PAYMENTS BY INVOICE, PARTIAL PAYMENT, ADVANCE PAYMENT, PAYPAL AND TWINT
8.1 Payment can be made either by invoice, advance payment, PayPal or TWINT.
8.2 The credit card costs and fees will be added directly to you when using PayPal.
The PayPal costs are as follows: 3.6% of the purchase price
8.3 If you select the payment method in advance, we will provide you with our bank details in the order confirmation

8.4 You only have the right to offset if your counterclaims have been legally established by a court

9.0 PAYMENTS BY PAYPAL
9.1 Commission costs arise when paying by credit card via PayPal.

10.0 PURCHASE ON INVOICE WITH PART PAYMENT OPTION (POWERPAY)
10.1 MF Group / POWERPAY, as an external payment service provider, offers the payment method “purchase on account”.
With the order invoice you can easily pay for your online purchase by invoice.
10.2 If you decide not to make a payment within the specified time frame, you will receive a subsequent payment
The following month a monthly invoice with an order overview.
10.3 When the purchase contract is concluded, POWERPAY takes over the resulting invoice claim and
handles the relevant payment arrangements.
10.4 When purchasing on account, you accept POWERPAY's terms and conditions in addition to our general terms and conditions. (powerpay.ch/de/agb).
You will receive the invoice free of charge by email, provided you have a valid email address.
10.5 Payment by invoice with POWERPAY
10.6 Pay conveniently and risk-free by invoice. Your order will be shipped immediately.
You will receive the invoice in the middle of the following month. It is provided by our payment partner Powerpay
(Powerpay General Terms and Conditions) delivered separately.
10.7 The payment deadline is until the end of the month or you choose a partial payment.
You can purchase up to CHF 5,000 by invoice.
10.8 Please note that an administration fee of CHF 2.90 and one
A one-time fee of 3.6% of the purchase price applies.
10.9 As part of this contract, MF Group Factoring AG / PowerPay grants you a consumer credit
according to Art. 12 KKG, provided you make use of the partial payment option and there is no reason for exclusion
according to Art. 7 Para. 1 KKG. You will receive the invoice free of charge by email, provided you have a valid email address.
11.0 PAYMENTS BY INVOICE BY PARTIAL PAYMENT WITH POWERPAY
11.1 With the PowerPay monthly invoice you can easily pay for your online purchase by invoice with a partial payment option.
11.2 MF Finance AG / PowerPay, as an external payment service provider, offers the payment method “payment by invoice”.
11.3 When the purchase contract is concluded, PowerPay takes over the resulting invoice claim and handles the corresponding payment modalities.
11.4 When purchasing on account, you accept PowerPay's General Terms and Conditions in addition to our General Terms and Conditions. (powerpay.ch/AGB) You will receive the monthly bill by post the following month.
11.5 In the case of partial payment, at least 10% of the outstanding invoice amount must be paid per month.
11.6 In this way, you can easily decide for yourself how many installments you would like to pay the invoice in.
11.7 Please note that an administration fee of CHF 2.90 and a one-off fee of 3.6% of the purchase price apply per invoice.
11.8 As part of this contract, MF Finance AG / PowerPay grants you a consumer loan in accordance with Art. 12 KKG,
provided you make use of the partial payment option and there is no reason for exclusion pursuant to Art. 7 Para. 1 KKG.

12.0 PAYMENT BY TWINT
12.1 TWINT Acquiring AG (hereinafter “TWINT”) is a Swiss stock corporation based in Zurich.
12.2 The TWINT system includes functions from the areas of payment and value-added services, which are available on the website.www.twint.ch are described in detail.
12.3 The costs and fees will be added to the total price of your products by TWINT when you use them.
12.4 TWINT costs 1.3% of Kasurcharge
13.0 RESERVATION OF TITLE
13.1 Goods purchased in store must generally be paid for in full in cash.
13.2 IfIf Swissplankton accepts payment of the contract price in store on account, these must be paid within 20 days. If the customer is in arrears with the payment of an invoice, a late payment interest of 1% per month and a reminder fee of CHF 20 per reminder will be due.
13.3 Until the contract price (store and online business) has been paid in full, all ofSwiss plankton
delivered goods are the property of Swissplankton. During this time, changing or disposing of the goods is not permitted without the express consent of Swissplankton.
14.0 WARRANTIES AND LIMITATIONS OF LIABILITY
14.1 All warranties for product defects are expressly excluded by Swissplankton. Swissplankton's warranty obligation is expressly limited to the passing on of Swissplankton's guarantee or warranty claims against the suppliers of the goods sold.
14.2 We no longer grant any warranty claims for products and goods that we offer on sale and in special offers.
14.3 Swissplankton assumes no liability for operational failures, bankruptcy or other performance deficiencies of product or service suppliers.
The customer must assert any rights directly against these third parties.
14.4 Product defects must be reported to Swissplankton by the customer within 5 days of discovering the defect. If reported on time
supports Swissplankton the customer in rectifying the defect in accordance with the warranty conditions of the product supplier. Swissplankton is not responsible for correcting the defect.
14.4 If a defective product is not available to the customer while the defect is being remedied, the customer is responsible for any replacement.
14.5 Claims for damages arising from breaches of contract (particularly when providing goods and/or services)
towards Swissplankton and/or their assistants are expressly excluded unless there is intentional or grossly negligent action.
Liability for indirect damages and consequential damages in connection with goods or services is expressly excluded.
15.0 APPLICABLE LAW, JURISDICTION
15.1 The contractual relationship between Swissplankton and the customer and all related matters
